GENERAL CONDITIONS OF SALE
ACCOMODATION - CATERING - SEMINARS & BANQUETS
1- RESERVATION AND CONFIRMATION :
A reservation confirmed by fax or mail implies the unconditional acceptance by the client or his representative of these conditions.
A reservation is only confirmed after signing the attached contract and paying a deposit of 50% of the total invoice amount.
2- RATES AND PAYMENT METHODS :
A/ These contractual rates must remain strictly confidential. They are subject to economic indexation, net of any commission.
B/ Payment shall be made on the day of receipt of the invoice, unless special conditions are stipulated in the contract.
In the event of late payment, the client shall be liable to pay compensation calculated on a daily basis on the basis of the legal interest rate in force plus 2 points.
All invoices under 500 € must be paid in full in cash before the departure of the participants.
3- GUARANTEEING THE NUMBER OF PARTICIPANTS :
The exact number of people attending meals or meetings must be confirmed in writing at least 48 working hours before the start of the event (for less than 50 people) and at least 5 working days before the start of the event (for more than 50 people). This number will be taken as the minimum basis for invoicing.
The adjustment of the number of people present may not be reduced by more than 15% of the initial order.
Any catering service not consumed as part of a package cannot result in a reduction in the price of the service.
In the event that the number of participants is lower than that mentioned on the quote, for whatever reason, the establishment reserves the right to change the lounge initially made available.
4- TOTAL OR PARTIAL CANCELLATION :
In case of cancellation, the deposit paid will not be refunded.
A/ For any cancellation occurring between 60 and 30 days before the arrival date of the participants, the hotel will charge one third of the price of the services booked and cancelled.
B/ For cancellations made between 30 and 10 days before the arrival date, the hotel will charge 50% of the price of the services booked and cancelled.
C/ For cancellations made less than 10 days before the arrival date, the hotel will charge the full price of the services booked and cancelled.
D/ The hotel reserves the right to unilaterally terminate, without notice or compensation, any contract whose object or cause is incompatible with the purpose of the rented premises, or contrary to good morals, or likely to disturb public order.
E/ The hotel reserves the right to unilaterally terminate the contract without notice or compensation after a simple formal notice has remained without effect, in the absence of payment by the client of all or part of the deposit paid on confirmation.
5- ACCOMMODATION for individual bookings (excluding group / seminar bookings)
You can cancel your reservation up to 48 hours before your arrival. After this period, the price of the first night will be charged. For stays of more than 2 nights, 30% of the total amount will be charged at the time of booking.
6- EXTRAS :
All extras (telephone, mini-bar...) must be paid for on site by each participant before their departure. If the participants fail to pay for these services, these sums will be invoiced directly to the client who is jointly and severally responsible for their payment.
7- LIABILITY AND INSURANCE :
The client, or failing that the organiser, acting as the client's representative, is liable for any damage, direct or indirect, that he or she or the participants may cause during the event.
The hotel declines all responsibility for damage of any kind (theft, deterioration, etc.) affecting goods of any kind (personal effects, equipment, etc.) brought by the organiser or belonging to participants, regardless of where the goods are stored (car park, lounges, etc.). The hotel will be released from all obligations in the event of an event of force majeure or fortuitous event (strike, fire, water damage, etc.).
8- ORGANIZATION :
A/ The client may not bring in any food or drink from outside without having obtained an exceptional dispensation from the Management. The latter reserves the right to impose a corkage fee.
B/ Any project for technical installations, various arrangements of the hotel's lounges and entertainment, will be submitted for examination and agreement before confirmation of the file.
C/ Upon expiry of the contract, the client will have the various materials, effects, documentation and equipment of any kind brought to the hotel premises at his request for the execution of the contract removed at his expense.
D/ The client undertakes to return all rented materials. In the event of damage or non-return, the hotel will demand reimbursement.
E/ Any damage whatsoever suffered by the hotel or its principals during the execution of the contract will be notified to the client by the hotel within 72 hours of the expiry of the contract and compensation will be demanded.
F/ Commercial events, exhibitions and presentations organised by the Client may only take place on the hotel premises after having obtained the approval or authorisation of the competent official authorities.
G/ Any musical event must be declared to the SACEM beforehand.
H/ The meeting rooms are available until 11 p.m., after this time a supplement will be charged.
9- CLAIMS :
Any dispute must be sent to the hotel by registered letter with acknowledgement of receipt within a maximum of 8 days after the departure of the participants. After this period, no claim can be satisfied. Nevertheless, the client undertakes to pay the undisputed part of the invoice in accordance with the terms of the contract, pending the resolution of any dispute.
10- COMPETENCE :
Any dispute relating to the present general conditions of sale will be the sole competence of the Courts of the Hautes-Pyrénées.
